On June 15, 2020, the Ministry of Industry and Trade of Vietnam issued Circular 11/2020/TT-BCT stipulating the Rules of Origin of goods in the Free Trade Agreement between Vietnam and the European Union (EVFTA).
Accordingly, the general provisions on the mechanism for certification of origin of goods are as follows:
Goods of EU origin imported into Vietnam are entitled to preferential tariffs under EVFTA when submitting one of the following proofs of origin:
+ C/O is issued according to regulations from Article 20 to Article 23 of Circular 11/2020.
+ A self-certification document of origin according to the provisions of Article 24 of Circular 11/2020, issued by a qualified exporter under the regulations of the European Union for shipments of any value; or any exporter for a shipment not exceeding 6,000 EUR (six thousand euros).
+ Self-certification documents of origin issued by the exporter registered in the electronic database in accordance with the regulations of the European Union and have been notified to Vietnam. The notice may include a provision that the European Union stops applying points a and b, clause 1, Article 19 of Circular 11/2020.
Goods of Vietnamese origin imported into the European Union are entitled to tariff preferences under the EVFTA when they have one of the following certificates of origin:
+ C/O is issued according to the provisions of Article 4 and Article 20 to Article 23 of Circular 11/2020.
+ Self-certification of origin according to the provisions of Article 25 of Circular 11/2020 issued by the exporter whose consignment is valued at no more than 6,000 EUR (six thousand euros).
+ Self-certification documents of origin issued by qualified exporters or registered exporters at the database in accordance with regulations of the Ministry of Industry and Trade.
+ The self-certification of origin of goods specified at point c, clause 2, Article 19 of Circular 19/2020 shall comply with the regulations of the Ministry of Industry and Trade and apply after Vietnam has notified the European Union.
– In the case of applying Article 29 of Circular 11/2020, originating goods are entitled to EVFTA preferences without submitting proof of origin documents as prescribed in Article 19 of Circular 11/2020.
Circular 11/2020/TT-BCT officially takes effect from August 1, 2020.
