The classification of a product to a certain HS code is based on the nature, composition, …. of the actual imported commodity at the import time, based on catalogue, technical documents (if any) or /and decided by the Customs Department of Commodity Verification. The actual inspection results of the Customs and announcement by the Customs Department of Commodity Verification are legal basis for applying HS code to imported good. Importers are ultimately responsible for ensuring that the products are correctly classified.

Ban on import, export
According to the current regulation, Wine grapes is not in the List of prohibited imports into Vietnam, so the enterprise can do the import procedure pursuant to current stipulations.

Governmental management on Wine grapes
Section 5. IMPORT OF ALCOHOL
Article 30. General provisions on import of alcohol
- The distributor having the license for alcohol distribution shall be entitled to import alcohol and take responsibility for the quality and food safety of imported alcohol. The distributor shall only sell imported semi-finished alcohol to the producer having the license for mass production of alcohol.
- The producer having the license for mass production of alcohol shall be entitled to import or authorize the import of semi-finished alcohol to produce finished alcohol.
- Apart from the provision of Article 31 stated herein, imported alcohol shall:
- a) have labels specified in accordance with the provision of Article 6 stated herein;
- b) obtain the note of the declaration of conformity or the written confirmation of the declaration of food safety (if types of alcohol are not regulated by technical regulations) granted by a competent state authority before imported and comply with regulations of state inspection on food safety applying to imported food.
- Alcohol shall only be imported into Vietnam through international checkpoints.
Article 31. Import of alcohol to follow procedures for issuance of notes of declarations of conformity or written confirmations of declarations of food safety
Every enterprise including the enterprise that has not obtained the license for mass production of alcohol or the license for alcohol distribution shall be entitled to import alcohol to follow procedures for issuance of the note of the declaration of conformity or the written confirmation of the declaration of food safety with the total volume not exceeding 3 liters/alcohol label. The imported alcohol mentioned above shall not be sold on the market.
(According to Decree No. 105/2017 / ND-CP dated September 14, 2017: Imported alcohol must be registered for the regulation conformity announcement at the competent authorities of Vietnam before importing and must be granted ” report the results of certification that food meets import requirements ”for each consignment according to current regulations)
Pursuant to Decree No. 38/2012 / ND-CP dated 25/4/2012 of the Government detailing the implementation of a number of articles of the Law on Food Safety, stipulating: “Transparent management of food safety process of production, processing, storage, transport, export, import and trading of wines, beer, soft drinks, processed milk, vegetable oil, flour and starch processing products , cakes, jams, candies, and containers under their management. ”
Therefore, alcohol on the list of imported goods must be inspected for quality assurance, technical regulations and food safety before customs clearance under the management responsibility of the Ministry of Industry and Trade promulgated under Decision 3648. / QD-BCT dated 08/09/2016 of the Ministry of Industry and Trade, it is required to conduct specialized inspection according to current regulations)
Customs procedure of import Wine grapes into Vietnam
Due to the above-mentioned commodity policy, when carrying out customs procedures for importing grape wines, apart from the same procedure as for ordinary goods, the importer must have a regulation conformity announcement and quality inspection and affix import stamps password
