Customs Declaration in Vietnam
Currently, according to the laws in Vietnam regarding customs declaration for a shipment:
- The cargo owner (exporter or importer) is responsible for the documents and the nature of the goods.
- The exporter or importer is responsible for customs declaration and other procedures with state agencies in accordance with relevant legal documents on state management of import and export goods and customs procedures.
The importer / exporter can declare by themselves or hire someone to perform customs declaration and work with customs authorities to clear the shipment.
In Vietnam, the person taking on the above work can be:
- A licensed customs brokerage approved by the General Department of Customs – hereafter referred to as “Licensed Customs Brokerage or Customs Agency,” or
- Anyone trusted and hired by the importer / exporter without any legal requirement for certification or qualification – hereafter referred to as a customs clearance agent.
For customs clearance agent serice (no license), the customs broker will perform procedures with customs authorities and other state agencies (if any) within the agreed scope with the Vietnamese importer / exporter and be responsible to the cargo owner for these contents. The person legally responsible for the declaration and compliance with procedures is the Vietnamese importer / exporter
For customs agency services (license required), the customs agency will perform procedures with customs authorities and other state agencies (if any) within the scope authorized in the agency contract with the Vietnamese importer / exporter. The person legally responsible for the declaration and compliance with procedures is the licensed customs agency.

What is a Licensed Customs Brokerage in Vietnam?
To become a licensed customs brokerage in Vietnam, a business needs to meet the following three conditions:
- Have a business registration certificate or enterprise registration certificate with the business line of freight forwarding or customs brokerage services.
- Have certified customs brokerage staff.
- Have IT infrastructure that meets the conditions for performing electronic customs declarations and other conditions as prescribed.
Customs Brokerage Staff in Vietnam
Clause 2, Article 20 of the Law on Customs stipulates:
Customs brokerage staff are Vietnamese citizens who meet the following conditions:
- Have a college degree or higher in economics, law, or engineering.
- Have a customs declaration certificate.
- Be granted a customs brokerage staff code by the customs authorities.
Customs Declaration Certificate
The examination for the Customs Professional Certificate is organized by the General Department of Customs at least once a year and includes three subjects:
- Foreign Trade
- Customs Law
- Customs Procedure
A passing score for each subject is at least 50 out of 100. To be granted a Customs Declaration Certificate, candidates must pass all three subjects (unless exempted).
Customs Brokerage Staff Code
The General Department of Customs grants a Customs Brokerage Staff Code to individuals with a Customs Declaration Certificate upon the request of a customs brokerage agency. This code is recorded on the customs brokerage staff card and used during their customs declaration career.
The Customs Brokerage Staff Code is valid for three years from the date of issuance. After this period, the customs brokerage must renew the code to continue their customs declaration services.
Renewing the Customs Brokerage Staff Code
Customs brokerage staff can renew their code if they meet the following conditions:
- Not subject to revocation of the customs brokerage staff code.
- Have participated in a supplementary customs law training course lasting at least three days (8 hours/day) organized by the Vietnam Customs School or colleges, universities, or academies with a customs specialty, with a unified training program with the General Department of Customs.
The customs brokerage must submit a renewal application for the customs brokerage staff code to the General Department of Customs. The renewal period is three years from the renewal date.
Customs agencies and customs brokerage staff must comply with their responsibilities according to the law. Violations can result in temporary suspension, termination of customs agency operations, or revocation of the customs brokerage staff code under Vietnamese law.
