What is a Certificate of Origin?
A Certificate of Origin or Declaration of Origin (often abbreviated to C/O, CO or DOO) is a document widely used in international trade transactions which attests that the product listed therein has met certain criteria to be considered as originating in a particular country.
Who is the certificate of origin for the goods?
A certificate of origin / declaration of origin is generally prepared and completed by the exporter or the manufacturer, and may be subject to official certification by an authorized third party.
It is often submitted to a customs authority of the importing country to justify the product’s eligibility for entry and/or its entitlement to preferential treatment.
Certificate of Vietnam origin
Currently, the Vietnamese government has many policies to facilitate exports, including the signing of preferential trade agreements on tax with more than 50 countries around the world. It is possible that the goods you want to import from Vietnam will enjoy special preferential tax when importing.
In particular, to enjoy tax incentives, the certificate of origin is a very important document.
Why is a certificate of origin required?
- The goods are certified as legal, have a clear certificate of origin by the Vietnamese state, and are fully taxed.
- A valid C/O will help the importer of goods enjoy preferential tariffs in case the importing country and the exporting country give each other preferential tariff through trade agreements.
- Ensure effective implementation of trade policies of countries: Imposing anti-dumping duties, safeguard duties, and anti-subsidy taxes on specific types of goods originating from specific countries; trade statistics, import quota control, etc.
How to apply for a certificate of origin
Step 1: Register a trader profile in case of applying for a certificate of origin for the first time.
The applicant wishing to be granted the Certificate of Origin (“C/O”) needs to register the trader profile under Vietnam regulations before submitting the dossier applying for C/O.
Trader profile includes:
1. Register the signature sample of the legal representative or authorized representative who is authorized to sign the application for the Certificate of Origin, sign the Certificate of Origin and the trader’s seal sample
2. A copy of the business registration certificate (the enterprise makes a copy of it);
3. List of goods-producing establishments applying for Certificate of Origin (if any)
Trader dossiers are declared electronically via the website at: www.ecosys.gov.vn or other websites of agencies and organizations issuing Certificates of Origin authorized by the Ministry of Industry and Trade.
In addition, traders can also submit a trader registration dossier at the head office of the agency or organization issuing the Certificate of Origin. The trader profile is updated as soon as there is a change, if there is no change, the trader still has to update the trader profile every 2 years.
Step 2: Preparing documents for issuance of certificates of origin
An application file for a certificate of origin includes the following papers and documents:
1. An application for a Certificate of Origin
2. The corresponding Certificate of Origin form;
3. A printed copy of the export customs declaration (except for the case where the exported goods are not required to be declared to the customs as prescribed by law);
4. A copy of the commercial invoice stamped with a true copy of the trader’s original;
5. A copy of the bill of lading or a copy of an equivalent transport document with a seal as a true copy of the trader’s original (except for the case of exporting goods in the form of delivery without using a bill of lading or transport document). other according to the provisions of law or international practice);
6. A detailed declaration of exported goods meeting the preferential origin criteria or the non-preferential origin criteria
7. Declaration of origin of the manufacturer or supplier of originating materials or domestically produced originating goods (according to the form prescribed by the Ministry of Industry and Trade in case such materials are used for a further step in the production of another good)
8. A copy of the goods production process with the trader’s stamp of the original;
9. Copies of other documents at the request of the agency or organization issuing the Certificate of Origin, such as:
– Customs declaration of import of raw materials and auxiliary materials used to produce exported goods (in case imported raw materials and auxiliary materials are used in the production process);
– Purchase contract or value-added invoice for purchase and sale of domestic raw materials and auxiliary materials (in case of using domestically purchased raw materials and auxiliary materials in the production process);
– Export license (if any);
Step 3: Submit application for certificate of origin
1/ Declare the application for a certificate of origin in electronic form:
Traders can declare dossiers of application for Certificates of Origin according to electronic forms available on the website: www.ecosys.gov.vn, other websites of agencies and organizations issuing Certificates of Origin. receive the origin of goods authorized by the Ministry of Industry and Trade or attach the application for the Certificate of Origin to these websites.
2/ Submit application for certificate of origin directly:
Traders shall directly submit dossiers of application for Certificates of Origin in paper form at the offices of the agencies or organizations that issue Certificates of Origin.
3/ Submit an application for a certificate of origin by post:
Traders shall submit dossiers of application for certificates of origin in paper form by post to the offices of agencies or organizations that issue certificates of origin.
