Notice 25/TB-CTVN of the CITES Management Authority of Vietnam on the proclamation of the List of Wild Fauna and Flora under the Appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora level (CITES) - Decree 57/2020/ND-CP dated May 25, 2020 of the Government amending and supplementing a number of articles of Decree No. 122/2016/ND-CP dated September 1, 2016 of the Government on the Export Tariff Imports, Preferential Import Tariffs, List of goods and absolute tax rates, mixed tax, import tax outside the tariff quota and Decree 125/2017/ND-CP dated November 16, 2017 amending, supplementing a number of articles of Decree No. 122/2016/ND-CP.

What kind of wood is banned from export?
- Logs, sawn timber from domestic natural forests Belonging to the list of goods banned from export in Appendix I – Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government
- Wood belongs to the species of forest plants that are threatened with extinction, which is strictly prohibited from exploitation and use for commercial purposes, and the species listed in CITES Appendix I, naturally distributed in Vietnam, are listed in Group IA – Plant species forest animals in Clause 1, Article, 4 Decree No. 06/2019/ND-CP dated January 22, 2019 of the Government.

The classification of a product to a certain HS code is based on the nature, composition, …. of the actual exported commodity at the export time, based on catalog, technical documents (if any), or /and decided by the Customs Department of Commodity Verification. The actual inspection results of the Customs and announcement by the Customs Department of Commodity Verification are the legal basis for applying the HS code to exported goods. Exporters are ultimately responsible for ensuring that the products are correctly classified.

Customs Duties on exporting Wood and Wood Products in Vietnam
- VAT: According to current regulations on export, VAT for exported goods is 0%
- Export tax: Many wood products and wood products are on the list of taxable goods when exported.
- Articles of chapter 94 are not on the list of goods subject to export tax
- Many items in Chapter 44 are on the list of goods subject to export tax. Export tax ranges from 0% to 25%
Currently, when exporting to member countries/territories of CPTTP, EVFTA, and UKVFTA, they can enjoy preferential export tax. Many export tax items are reduced by more than 50% (from 25% to 10% or from 10% to 5%). Therefore, taking advantage of tax incentives should be very important.
